Welcome to ICM Trainer ("the App"). These Terms of Use ("Terms") govern your use of the App provided by GTO Solutions AS ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
2. Description of Service
ICM Trainer is a poker study and training tool for exploring full preflop solution trees and practicing selected tournament scenarios using pre-computed GTO (Game Theory Optimal) solutions based on the Independent Chip Model. The App does not facilitate or involve real-money gambling.
3. Changes to Terms
We reserve the right to modify or update these Terms at any time. Any changes will be effective immediately upon posting within the App. Your continued use of the App after any such changes constitutes your acceptance of the new Terms.
4. Use of the App
4.1 Eligibility
You must be at least 18 years old to use the App. By using the App, you represent and warrant that you meet this age requirement.
4.2 License
We grant you a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms.
5. Intellectual Property
All content, features, and functionality within the App, including but not limited to software, training data, algorithms, text, graphics, logos, and images, are the exclusive property of GTO Solutions AS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
6. User Conduct
You agree not to:
- Use the App for any unlawful purpose.
- Reverse engineer, decompile, or disassemble any part of the App.
- Extract or attempt to extract training data or algorithms.
- Circumvent, disable, or otherwise interfere with security-related features of the App.
- Redistribute, sell, or commercially exploit the training data.
7. Disclaimers
7.1 No Professional Advice
The App provides ICM training exercises intended for educational and training purposes only. It is not intended to provide professional poker advice or guarantee any results in real poker games. Use of the App is at your own risk.
7.2 No Real-Money Gambling
The App is a training and study tool only. It does not facilitate or encourage real-money gambling.
7.3 "As Is" Basis
The App is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy or completeness of the App's content or training solutions.
8. Limitation of Liability
In no event shall GTO Solutions AS, its affiliates, or their licensors be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App.
9. Indemnification
You agree to indemnify, defend, and hold harmless GTO Solutions AS and its affiliates from and against any and all claims, liabilities, damages, losses, or expenses arising out of your use of the App or violation of these Terms.
10. Termination
We reserve the right to terminate or suspend your access to the App, without prior notice, for any violation of these Terms or for any other reason. Upon termination, your license to use the App will immediately cease.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
13. Entire Agreement
These Terms and our Privacy Policy constitute the entire agreement between you and us regarding the use of the App.
